Alimony indexation 2026: by what percentage does your spousal and child support increase?

·2 min read·Ömür Arslan

Every year on 1 January, alimony is automatically indexed. Read how the 2026 indexation works, by what percentage your payments increase, and what to do if your ex refuses to pay.

Every year, statutory alimony automatically increases by a fixed percentage — the so-called statutory indexation. This applies to both spousal support and child support. Many people don't realise this increase applies automatically, without a new court ruling, which causes unnecessary disputes and arrears every year.

What is statutory indexation?

Statutory indexation is an annual, legally determined increase in alimony amounts, intended to keep support payments in line with average Dutch wage growth. The percentage is set by the Minister of Justice and Security and published in the Government Gazette each year in late November, taking effect on 1 January.

Importantly, indexation applies automatically, by operation of law. Neither party needs to go to court, unless the divorce settlement explicitly excludes indexation.

How do you calculate the new amount?

New amount = old amount × (1 + indexation percentage)

For example, if you paid €450 per month in child support in 2025 and the 2026 indexation is 3.5%, the new amount becomes €465.75 per month. The percentage typically ranges between 2% and 6% and is published in good time by the National Agency for the Collection of Maintenance Payments (LBIO).

What if your ex refuses to pay the indexed amount?

This happens often in practice. Because indexation applies automatically, arrears arise immediately, even without a new ruling — you don't need to go to court first to claim the indexed amount. Options include sending a formal demand, involving the LBIO for enforced collection (including wage garnishment), engaging a bailiff, or consulting a lawyer for structural issues.

Can alimony change outside of indexation?

Yes, through a change of circumstances — income changes, a new relationship for the recipient, the child starting work, or a changed care arrangement. This does require a court request, unless both parties agree and record it in a new settlement.

Duration of spousal support

Since the 2020 legal reform, spousal support is generally capped at five years, with exceptions for longer marriages with young children. Indexation continues to apply throughout this period.
