Deed of Conveyance
The deed of delivery is the notarial deed by which ownership of immovable property is transferred.
The deed of conveyance, also known as the transfer deed, is a notarial instrument drawn up by a notary that effects the legal transfer of real property. In the Netherlands, title to immovable property may be transferred only by registration of such a notarial deed in the public registers of the Land Registry.
This deed typically follows a purchase agreement and ensures that all conditions for the transfer have been fulfilled, including payment and any resolutive conditions. The notary verifies the identity of the parties, the absence of encumbrances and other relevant facts before the deed is executed.
The deed of conveyance is of considerable importance for legal certainty: both the transferee and third parties may rely on the registration in the public registers.
“After the deed of transfer had been executed before the notary, ownership of the property was registered in the Land Registry.”
