Business Premises 230a

230a business premises refers to leases of non-residential properties governed by Article 7:230a of the Dutch Civil Code that do not qualify as retail premises under Article 7:290 of the Dutch Civil Code.

Article 7:230a of the Dutch Civil Code governs the lease of business premises intended for the conduct of a trade or profession, but which do not qualify as retail or hospitality property. This regime is distinct from residential tenancies and from the more extensive protection afforded under Article 7:290 BW, in that it provides a lighter form of tenant protection.

The provision is relevant in that the landlord is required to give notice of termination of the lease agreement together with reasonable grounds. The tenant may lodge an objection, whereupon the court will determine whether termination is justified. This framework strikes a balance between contractual freedom and the protection of the tenant.

In practice, Article 230a business premises are frequently leased for offices, storage facilities, workshops and other commercial purposes. Such leases typically provide for shorter terms and lower thresholds for termination than those applicable to retail or residential property.

“The landlord terminated the lease of the 230a business premises because he wished to use the property himself for his own business activities.”
