Administrative Law
Administrative law is the branch of law that governs the relationship between public authorities and citizens, in particular with regard to the adoption and enforcement of decisions by administrative bodies. It affords citizens legal protection against acts of government.
Administrative law, also known as public administrative law, governs the conduct of administrative authorities such as municipalities, provinces and ministries. It regulates, among other matters, the preparation, adoption and publication of decisions, together with the requirements applicable to them.
Its relevance lies in the legal protection it affords to citizens and businesses against the government. Through procedures such as objection, appeal and further appeal, they may challenge decisions affecting them, for example in the areas of permits, subsidies or enforcement.
In practice, administrative law plays a significant role in disputes concerning environmental law, social security law and tax law, where the administrative courts review whether the government has acted lawfully.
“The attorney filed a notice of objection with the municipality on behalf of the client, on the ground that the decision was contrary to administrative law.”
