Administration

Administration is a statutory measure whereby the subdistrict court transfers the management of an adult’s assets to an administrator because that person is unable to manage their financial interests themselves.

Administration, also known as the imposition of administration, is governed by Book 1 of the Civil Code and serves to protect vulnerable adults. The administrator assumes management of the assets and income, while the individual concerned retains, in principle, the capacity to perform legal acts not relating to the administration.

The measure is instituted upon the application of the individual concerned, their family, an institution or the Public Prosecution Service. The cantonal judge assesses whether a mental or physical condition exists that renders independent management impossible.

In practice, administration is frequently combined with mentorship and affords protection against creditors, waste and exploitation, while the administrator periodically renders accounts to the court.

“The subdistrict court judge has placed the client’s assets under administration, enabling the administrator to settle the rent arrears and prevent the accrual of further debts.”
