Construction Law
Construction law is the body of rules regulating the construction, alteration and demolition of buildings, in particular through permits and technical requirements.
Construction law encompasses the statutory frameworks governing the realization of buildings, including the requirement for an environmental permit, the Building Decree, and the standards relating to structural safety, fire safety and sustainability. It forms part of environmental law and imposes obligations on both public and private parties.
Its relevance lies in preventing unsafe or unlawful construction activities and safeguarding the quality of the built environment. Breaches may give rise to enforcement measures, administrative fines or liability.
In practice, construction law is relevant to project development, building contracts and disputes concerning permits or construction defects.
“The municipality refused the environmental permit because the building plan was contrary to the applicable planning legislation.”
