Compensation

Compensation is a monetary payment received by a party to compensate for loss or damage suffered.

Compensation is a legal mechanism whereby one party receives redress to compensate for the detriment caused by another party. This may arise from contractual arrangements, statutory obligations or judicial decisions.

In Dutch law, compensation is relevant across various fields of law, including employment law, the law of obligations and administrative law. It serves to restore aggrieved parties to their original position, insofar as possible.

In practice, compensation is frequently determined on the basis of proof of loss and may encompass both pecuniary and non-pecuniary damages.

“The court awarded the claimant compensation for the loss caused by the breach of contract.”
