Jurisdiction

Jurisdiction is the statutory authority of a court to hear and adjudicate a particular case.

Jurisdiction refers to the authority of a court to take cognizance of a dispute. This authority is determined by rules concerning the nature of the case, the amount claimed and the domicile of the parties.

In practice, the correct identification of the competent court prevents a case from being brought before the wrong instance, which may result in referral or a declaration of inadmissibility. Lawyers therefore invariably verify the jurisdictional rules before commencing proceedings.

“The lawyer submitted that the Rotterdam District Court lacked jurisdiction, as the defendant was domiciled in Amsterdam and the dispute fell within the competence of the subdistrict court.”
