Commission

Commission is the remuneration that a broker receives for mediating the conclusion of an agreement, such as in the purchase or lease of real property.

Commission, also known as broker’s commission, is the remuneration to which a broker is entitled for successfully mediating between parties in the conclusion of an agreement. This fee is typically calculated as a percentage of the transaction value and is provided for in the brokerage agreement.

Under Dutch law, commission is significant in that it constitutes the financial incentive for brokers to provide their services. It may give rise to disputes regarding the amount payable, the obligation to pay and the party liable for payment, particularly in the event of cancellation of a transaction.

In practice, commission is commonly encountered in the real estate sector, where buyers and sellers frequently engage brokers. The fee generally ranges between 1% and 3% of the purchase price, depending on the terms agreed and the complexity of the transaction.

“The seller paid the commission to the broker after the successful sale of the property.”
