Expert's report

An expert report is a written report by an expert appointed by the court that addresses technical or specialized questions arising in legal proceedings.

An expert report is commissioned in civil proceedings when the court requires specialized knowledge falling outside its own expertise. The expert examines the facts and provides objective answers to the questions formulated by the court.

Such a report is of considerable importance to the fact-finding process and may substantially influence the outcome of the case. The parties may submit comments on the draft report and, in certain circumstances, request a counter-expertise.

In practice, expert reports are commonly used in construction disputes, medical liability matters and valuation issues.

“The court has ordered an expert report to determine the extent of the damage to the dwelling.”
