Property boundary
The boundary line is the imaginary line separating the ownership of two adjacent parcels of land from each other.
The boundary line constitutes the legal division between two adjacent parcels of land and determines the point at which the ownership rights of one proprietor end and those of the other begin. This boundary is of considerable importance in disputes between neighbors concerning plantings, fences, walls, or structures erected too close to the boundary.
In practice, the location of the boundary is established by reference to cadastral records, historical deeds, or a survey. Uncertainty in this regard may give rise to court proceedings or to applications for a boundary determination.
Accordingly, upon the transfer of real property or in connection with alterations thereto, it is essential to ascertain the boundary with precision in order to prevent future disputes.
“The neighbour claims that the new fence extends several centimetres beyond the property boundary.”
