Ex nunc
From now onwards.
Ex nunc is a Latin term meaning "from now" and refers to a legal consequence that takes effect solely from the moment of the judgment or decision.
Ex nunc denotes that a judicial ruling, annulment or modification of a legal relationship takes effect only as from the moment the decision is rendered. This differs from ex tunc, under which the effect operates retroactively to the creation of the legal relationship.
In Dutch law the term is used primarily in administrative law and contract law. Where a decision or agreement is annulled, the court may determine that the annulment shall operate ex nunc, so that prior acts and legal transactions remain unaffected.
The application of ex nunc promotes legal certainty and protects third parties who have acted in good faith on the basis of the existing situation.
“The administrative court annulled the decision ex nunc, so that the permit already granted and the subsequent acts remained unaffected.”
