Executoriale titel

Enforceable title

An enforceable title is an official document that grants a creditor the right to enforce a claim through coercive measures, such as attachment.

An enforceable title constitutes the statutory basis for enforcement under Dutch law. Without such a title, a bailiff may not take enforcement measures against the debtor.

The title may consist of a judgment, a notarial deed with enforceable force, or an enforcement order. The law imposes strict requirements on form and content in order to prevent abuse and to protect the debtor’s rights.

In practice, the enforceable title is indispensable in collection and attachment proceedings, as it authorises the bailiff to proceed with compulsory recovery.

“With the enforceable title obtained, the bailiff was able to attach the defaulting debtor’s bank account.”
