Exploot
Writ
An exploit is an official document drawn up and served by a court bailiff on a party in legal proceedings.
An exploot is a formal instrument of service by which a bailiff notifies a party of a legal act, such as a summons, judgment or attachment. The document contains the particulars prescribed by law and is delivered personally or in the manner required by statute.
The exploot constitutes formal notice and proof of service, thereby triggering the commencement of applicable time periods and confirming that the recipient has been duly informed. In practice, it is used in summons proceedings, enforcement measures and other situations requiring official notification.
“The bailiff served the judgment on the judgment debtor by formal process.”
