Manufacturer's Warranty
A manufacturer's warranty is the warranty granted by the manufacturer in respect of defects in the materials or workmanship of a product. Such warranty is typically limited in duration and scope and applies in addition to the statutory warranty.
The manufacturer's warranty, also known as the factory warranty, is a voluntary undertaking by the producer that the product will meet the specified quality standards for a given period. In the event of defects, the buyer may claim repair, replacement or, in some cases, a refund, provided the conditions are met.
Under Dutch law, the manufacturer's warranty is supplementary to the statutory warranty that the seller must provide under the Civil Code. Consumers may enforce it directly against the manufacturer, which is particularly relevant for imported products or technical equipment where the seller offers no warranty of its own.
In practice, claims under the manufacturer's warranty are often submitted through the seller, although the terms are set out in the warranty certificate. It is important to review the conditions, including any exclusions for misuse or damage caused by the buyer's own actions.
“The customer invoked the manufacturer's warranty when the washing machine became defective within two years.”
