Respondent

The respondent is the party against whom an appeal has been lodged in civil proceedings.

In Dutch civil procedural law, the respondent is the opposing party to the appellant in appeal proceedings. This party is joined in the appeal by the appellant and is afforded the opportunity to submit a defence to the grounds of appeal advanced.

The term is significant because, in appeal proceedings, the respondent may file a reply memorandum, thereby defending the judgment rendered at first instance. The respondent’s position materially influences the conduct and outcome of the appeal.

In practice, the respondent is served with a summons on appeal or a notice of appeal and must respond within the prescribed statutory time limits in order to preserve its procedural rights.

“The respondent's counsel timely filed a memorandum of reply to refute the appellant's grounds of appeal.”
