Community
A community is a legal relationship in which two or more persons are jointly the owners of property or assets, without constituting a partnership.
Under Dutch law, a community of property arises inter alia upon marriage subject to the statutory community of property regime, upon succession or upon the joint acquisition of immovable property. Each co-owner holds a share in the jointly owned assets but may not dispose of them unilaterally without the consent of the other co-owners.
This renders the community relevant in the context of divorce, the division of estates and the administration of estates. In practice, such a community is typically terminated by means of a partition whereby the assets are allocated to the individual proprietors.
“After the death of their parents, the heirs found themselves in a community of the estate.”
