Important reason

A compelling reason is a grave circumstance that justifies an exceptional measure, such as the immediate termination of an employment contract without notice.

In Dutch employment law, a weighty reason denotes a compelling ground that permits the immediate dissolution or termination of an employment contract. This concept finds particular expression in summary dismissal, where the reason must be sufficiently serious to dispense with standard procedures.

Its relevance lies in safeguarding the parties against unreasonable terminations: absent a demonstrable weighty reason, such a dismissal is frequently invalid and may give rise to continued wage payments or damages. The court evaluates the facts and circumstances to determine whether the reason is sufficiently compelling.

In practice, the concept is invoked in cases of serious misconduct, such as theft or threats, where the employer must act promptly to mitigate further harm.

“The employer terminated the employment contract on the grounds of a serious reason, namely repeated theft of company property.”
