Goed
Good
A good is an object that may be the subject of ownership rights or other patrimonial rights.
In Dutch law, a good is understood to mean any object, whether movable or immovable, tangible or intangible, that can form part of an estate. Goods constitute the foundation for ownership, limited rights and other proprietary rights as provided for in Book 3 of the Civil Code.
The term is significant in that it determines which items may enter into legal transactions and be made subject to rights. Absent qualification as a good, no rights in rem may be created.
In practice, the concept is applied in contracts of sale, enforcement proceedings, bankruptcy and the division of joint estates, where it is necessary to determine which objects qualify as goods.
“The car and the claim against the debtor are both assets belonging to the debtor’s estate.”
