Rental price clause

A rent clause is a contractual provision in a lease agreement that fixes the amount of the rent, including any indexation or adjustment mechanisms.

A rent clause forms a core component of a lease agreement and governs the tenant’s financial obligations to the landlord. It sets out not only the initial rent but also the conditions under which the rent may be adjusted, whether by reference to inflation, statutory provisions or agreed indexation.

In Dutch rental law, particularly in relation to residential property, such a clause is significant on account of the tenant’s strong statutory protection. It safeguards against unreasonable increases and clarifies the tenant’s payment obligations. In disputes, the clause may prove decisive in proceedings before the Rent Tribunal or the courts.

In practice, a rent clause is frequently linked to the housing valuation system in order to establish the maximum permissible rent and is regularly updated to reflect changing market conditions.

“The lease agreement contained a rent clause providing for an annual increase based on the CPI index.”
