Tenancy Law

Landlord and tenant law is the field of law that governs the rights and obligations between landlords and tenants in the leasing of residential or commercial premises.

Tenancy law forms part of civil law and governs the lease agreement, including its formation, duration, rent and termination. It affords tenants specific protections, such as security of tenure and rules on maintenance and defects.

In Dutch practice, tenancy law is relevant to disputes concerning termination, rent increases or renovations. Lawyers act for both private tenants and landlords as well as commercial parties to enforce or defend rights.

Tenancy law distinguishes between residential and commercial premises, each subject to its own procedures and time limits that are strictly applied by the courts.

“The tenant invoked tenancy law to contest the termination of the lease.”
