Collection costs

Collection costs are the expenses incurred by a creditor in recovering an outstanding claim from a defaulting debtor. These costs may be passed on to the debtor subject to certain conditions.

Collection costs refer to the expenses incurred by a creditor in recovering an outstanding debt. These include, among other things, fees for collection agencies, bailiffs and any legal assistance.

Such costs are relevant because they increase the debtor’s overall liability and serve as an incentive for timely payment. Dutch legislation, in particular the Collection Costs Act, regulates the maximum amounts that may be charged in order to prevent excessive costs.

In practice, collection costs are generally only charged after the payment term has expired and a formal demand has been made. It is important that these costs remain reasonable and proportionate to the principal claim.

“After the payment term had expired, the supplier sent a demand letter announcing that collection costs would be charged in the event of further default.”
