Personal injury
Personal injury damages are the losses suffered by a person as a result of physical or mental injury caused by a wrongful act or accident. They encompass both pecuniary and non-pecuniary losses.
Personal injury is a term from the law of liability referring to the consequences of physical or psychological injury for a victim. This includes costs for medical treatment, rehabilitation and domestic assistance, as well as loss of income and damages for pain and suffering.
In the Netherlands, personal injury is relevant because victims may restore their financial and personal position through an award of damages. The liable party or its insurer is obliged to compensate the loss where fault or strict liability is established.
In practice, personal injury claims are frequently handled by specialist lawyers who obtain medical reports and negotiate the quantum of compensation, including future losses.
“The client claimed damages for personal injury sustained in a traffic accident in which he incurred permanent back complaints.”
