Medezeggenschap
Co-determination
Employee participation is the right of employees to influence the policy and decision-making within an enterprise. This right is primarily exercised through a works council.
Employee participation is a core concept in Dutch employment law, granting employees a voice in matters affecting their working conditions and the enterprise. It is statutorily enshrined in the Works Councils Act (WOR) and seeks to strike a balance between the interests of the employer and those of the employees.
The institution is relevant as it contributes to improved employment relations, greater buy-in for decisions and the prevention of disputes. By facilitating structured consultation and advice, employee participation fosters transparent and constructive cooperation within the organisation.
In practice, employee participation is mandatory in enterprises with fifty or more employees. The works council holds advisory and consent rights on matters such as reorganisations, terms of employment and social affairs, enabling employees to participate actively in decisions concerning their work environment.
“The management has requested the advice of the works council on the proposed merger, in accordance with the rules governing employee participation.”
