Negatieve boedel
Negative estate
A negative estate is an estate in which the debts exceed the value of the assets.
A negative estate arises where, upon death, the liabilities exceed the assets. In principle the heirs inherit nothing and may even incur personal liability if they accept the estate unconditionally.
This concept is significant because heirs in such cases frequently elect to accept the estate subject to the benefit of inventory in order to shield their personal assets from the deceased’s debts. Notaries and legal practitioners advise on this to avoid unnecessary exposure to liability.
In practice, negative estates commonly arise in the estates of persons who died with substantial debts, for example following bankruptcy or unpaid tax liabilities, and require careful administration through the courts or a notary.
“The heirs elected to accept the negative estate with the benefit of inventory in order to avoid personal liability.”
