Observator
Observer
An observer is an investigative officer who, as part of a criminal investigation, systematically conducts observations in order to gather information about persons or situations.
In Dutch criminal procedure, an observer is understood to mean a police officer tasked with carrying out observations. Such observations may be either static or mobile and are governed by the provisions of Article 126g of the Code of Criminal Procedure where systematic observation is concerned.
The deployment of an observer requires, as a rule, an order from the public prosecutor. The objective is to obtain insight into criminal activities without the suspect becoming aware of the surveillance. Information gathered by the observer may be adduced as evidence in subsequent criminal proceedings.
In practice, the term is used primarily within criminal investigation departments and special investigation services. The observer typically operates as part of a team and must comply with strict protocols to ensure the lawfulness of the information obtained.
“The public prosecutor authorised the observer to follow the suspect for several days.”
