maintenance period

The maintenance period is the period stipulated in the contract after completion during which the contractor is obliged to remedy defects and carry out maintenance on the completed works.

In construction law, and in particular in contracts for works, a maintenance period is frequently agreed following completion. During this period, the contractor remains liable for remedying any defects that arise, without the client incurring additional costs.

This concept is relevant as it governs the parties’ rights and obligations after completion and prevents the client from being confronted with unexpected repair costs immediately upon handover. In practice, the duration of the maintenance period is commonly stipulated in the contract or the general terms and conditions, such as the UAV 2012.

The maintenance period is distinct from statutory limitation periods and applies solely to the contractor’s contractual liability.

“Following handover of the property, the one-year maintenance period commenced, during which the contractor was required to remedy all reported defects.”
