Works Council

The works council is a statutory body that represents the interests of the employees in an enterprise and consults with the employer on decisions affecting the staff.

The Works Council is established pursuant to the Works Councils Act and is mandatory for undertakings with fifty or more employees. This body represents the employees, receives information from the employer and holds advisory and consent rights in relation to, among other matters, reorganisations, mergers and changes to terms and conditions of employment.

The Works Council plays an important role in promoting employee participation and prevents decisions from being taken unilaterally. By being involved in a timely manner, the Council can influence policy and contribute to balanced decision-making.

In practice, the Works Council meets regularly with the management board and may also take the initiative to place items relevant to the workforce on the agenda.

“The management has requested the advice of the works council on the proposed relocation of the head office.”
