Summary proceedings for the lifting of an attachment
An attachment-lifting summary proceeding is an expedited procedure before the interim relief judge to lift a conservatory attachment.
An application for the lifting of an attachment in summary proceedings is a summary action brought for the purpose of securing the release of an attachment. Such proceedings are frequently initiated where a party considers that a conservatory attachment has been levied without proper justification or necessity and seeks prompt relief.
In Dutch practice, this procedure provides an effective mechanism for mitigating the impact of an attachment, for instance on bank accounts or real property. The judge in summary proceedings determines whether sufficient grounds exist to maintain the attachment, having regard to the respective interests of the parties.
The procedure is particularly relevant in commercial disputes and debt recovery matters, where swift intervention is required to avert further loss.
“The debtor commenced summary proceedings seeking the lifting of the attachment on his bank account.”
