Opzegtermijn
Notice period
The notice period is the statutory or contractual period that must be observed before an agreement, such as an employment contract, can be terminated.
The notice period is the interval between the giving of notice and the actual termination of the agreement. This period may derive from statute, a collective agreement or the individual contract and varies according to the length of the employment relationship or the nature of the agreement.
In Dutch employment law, the notice period protects both the employee and the employer against abrupt termination. It provides for a reasonable transition period during which the parties may prepare for the end of their working relationship.
In practice, the notice period must be calculated and observed correctly in order to avoid penalties, continued payment obligations or annulment of the dismissal. Lawyers regularly advise clients on its proper application in dismissal or contract termination matters.
“The employer took the two-month notice period into account before terminating the employment relationship.”
