Peildatum
Reference Date
The valuation date is the reference date on which the value of assets or the factual situation is determined for the purposes of legal calculations or decisions.
The reference date is a fixed date used in Dutch law to establish the condition or value of matters at a particular point in time. This avoids disputes over subsequent changes and safeguards legal certainty in the resolution of disputes.
The term is particularly relevant in family law in the context of divorce, in corporate law for valuations, and in tax proceedings. The choice of reference date may affect the outcome of a case and is frequently stipulated in a judgment or agreement.
In practice, the parties or the court fix the reference date, for example as the date on which a petition is filed or another relevant event occurs.
“The court has selected 15 March 2022 as the reference date for the valuation of the shares in the jointly owned company.”
