Plagiarism
Plagiarism is the reproduction of another person’s work without permission or source attribution and the presentation of such work as one’s own. It constitutes an infringement of copyright.
Plagiarism refers to the unauthorised reproduction or presentation of another’s intellectual work, such as texts, ideas or creations, without proper attribution. Under Dutch law, this falls within the scope of the Copyright Act, which confers exclusive rights on the original author and renders plagiarism subject to civil liability.
In practice, plagiarism is frequently identified in academic or commercial publications. Counsel then examine whether the work displays sufficient originality and whether infringement has occurred, after which damages, rectification or injunctive relief may be sought.
“The publisher instituted proceedings for plagiarism after passages from the book had been reproduced without attribution.”
