Plurality
Plurality is the situation in which a single act falls under multiple penal provisions.
Plurality arises when a single act meets the definition of more than one offence under the Criminal Code or other statutes. This gives rise to concurrence of penal provisions, in which the court, applying rules such as specialty, absorption or subsidiarity, determines which provision takes precedence.
Its significance lies in preventing double punishment for the same act and ensuring proportionate sentencing. In practice, plurality commonly arises in complex cases, such as violent offences that may qualify as both assault and threat, requiring counsel or the court to select the appropriate classification.
“The court held that there was plurality, as the facts fell within the scope of both Article 310 and Article 311 Sr.”
