To complain
Making a complaint means giving timely and clear notice to the other party of a defect in a product or service.
Complaining means that a party, typically a consumer or principal, notifies the supplier or service provider, whether in writing or orally, of a failure in the performance of the contract. This constitutes a prerequisite for invoking certain legal remedies, such as repair, replacement, price reduction or termination.
It is relevant because it enables the other party to remedy the complaint and prevents rights from being lost through prescription or failure to observe complaint periods prescribed by law or set out in general terms and conditions. Without timely notice, the aggrieved party may forfeit its claims.
In practice, complaints are commonly submitted by email or registered letter, accompanied by a clear description of the issue and a reasonable period for rectification.
“The customer has lodged a complaint with the supplier regarding the missing component of the ordered machine.”
