Rectificatie

Rectification

Rectification is the correction of a manifest error in a judicial decision or other official document without altering its substantive purport.

Rectification concerns the correction of obvious errors, such as calculation or clerical mistakes, in a judgment, order or other legal instrument. The procedure is designed to safeguard the accuracy of the decision without necessitating a full appeal.

In practice, rectification is requested before the court that rendered the decision, usually by the party that has identified the error. The court may effect the rectification of its own motion or upon request, provided that the error does not affect the substance of the ruling.

This mechanism promotes the efficiency of the administration of justice and prevents unnecessary proceedings concerning purely formal inaccuracies.

“The lawyer filed a request for rectification on the grounds that the judgment stated the incorrect date of the hearing.”
