Reflexwerking
Reflex effect
The reflex effect is the indirect influence of European provisions lacking direct effect on the interpretation of national law. National courts interpret national law in conformity with the objectives of EU directives.
Reflex effect, also referred to as conforming interpretation, means that provisions of EU directives lacking direct effect nonetheless take effect through the interpretation of national law. This mechanism ensures that the purpose of European legislation is observed within the national legal order, without the directive itself serving as a legal basis.
Its relevance lies in the fact that many directives, owing to their wording or insufficient precision, lack direct effect. Reflex effect therefore provides an alternative means of giving effect to European standards and filling gaps in national legislation.
In practice, reflex effect is regularly applied in cases concerning consumer law, employment law and environmental law, with courts interpreting national provisions in light of European directives so as to reach an outcome consistent with EU law.
“The court applied the reflexive effect by interpreting the national provision on unfair terms in accordance with the European consumer protection directive.”
