Salvo titulo

Without title.

Salvo titulo is a Latin term meaning “subject to title” and used to reserve ownership rights or claims.

The expression salvo titulo is used in legal instruments and agreements to indicate that a party is acting without definitively acknowledging or transferring title or ownership. This reservation prevents acts from being construed as tacit recognition of proprietary rights.

In Dutch notarial and contractual practice, the term appears in transfers, mortgages and estate administrations where the parties are acting on a temporary or conditional basis. It affords protection against the unintended relinquishment of rights and ensures legal certainty regarding claims that are expressly reserved.

“The heir accepted the estate salvo titulo in order to preserve his rights in the immovable property.”
