Sui generis

Of its own kind

Sui generis is a Latin term meaning "of its own kind" and refers to a unique legal regime that falls outside existing statutory categories.

The term “sui generis” is used in Dutch law to indicate that a given subject matter requires its own tailor-made statutory protection because existing rules are inadequate. This arises most frequently in the field of intellectual property rights, such as the sui generis protection of databases and plant variety rights, for which dedicated legislation has been enacted.

The term is significant because it enables legislators and courts to provide bespoke solutions for new technological or societal developments without disturbing the existing legal framework. In practice, the concept is regularly invoked in disputes concerning innovative products or services that do not clearly fall within the ambit of traditional statutes such as the Copyright Act or the Patents Act.

“The database producer relied on sui generis protection because copyright did not afford adequate protection.”
