Term protection
Term protection is the statutory protection enjoyed by a tenant against termination of the lease agreement at the end of the agreed term.
Term protection forms part of Dutch tenancy law and prevents a landlord from terminating a lease agreement without further formality once the agreed rental term expires. The law imposes strict conditions on termination, thereby preserving the tenant’s strong position.
This protection is relevant because it affords tenants security of tenure and prevents the abuse of fixed-term contracts. Without term protection, the rental market would be less stable and tenants would face a greater risk of losing their homes.
In practice, a landlord wishing to terminate the tenancy must often initiate court proceedings and establish that the property is urgently required for their own use or that other statutory grounds apply.
“Thanks to the term protection, the tenant was able to successfully challenge the termination of the lease agreement before the court.”
