Damage to real property
Real estate damage is damage to immovable property, such as buildings or land, that reduces its value or usability.
Real property damage refers to material damage to immovable property caused by events such as accidents, construction defects, natural disasters or tortious acts. The damage may consist of structural defects, contamination or a diminution in the value of the property.
In Dutch law, real property damage is relevant within the law of liability and insurance law, under which the injured owner may be entitled to compensation for repair costs or loss of value. Establishing the damage often requires an expert report.
In practice, real property damage regularly gives rise to proceedings concerning liability and the scope of compensation, for example in neighbour disputes or following a fire.
“The contractor was held liable for the property damage caused by defective foundation works.”
