Pecuniary damage

Pecuniary loss is the financial loss suffered by an injured party as a result of a diminution in their assets, such as repair costs, loss of income or diminution in value.

In Dutch law, pecuniary damage refers to material loss consisting of a concrete reduction in the assets of a natural person or legal entity. This may include direct loss, such as expenditure on repair or replacement, and indirect loss, such as lost profits or forgone income.

Such damage is relevant in liability claims based on tort or breach of contract, as the injured party is entitled to compensation under Article 6:95 of the Dutch Civil Code, provided that causation and the extent of the damage are established.

In practice, pecuniary damage is frequently quantified by reference to invoices, payslips or expert reports so that its precise extent may be determined and substantiated in civil proceedings.

“The claimant sought compensation for pecuniary loss consisting of repair costs and lost earnings following the traffic accident.”
