Petition

A petition is a formal written document by which a party requests a court or an administrative body to render a specific decision.

An application is a written request submitted to a court or other authority to obtain a specific measure or ruling. It is used in application proceedings, such as those in family law, succession law and administrative law, and often constitutes the commencement of the proceedings.

Unlike a writ of summons, an application is intended for situations in which no defence is anticipated or in which the law prescribes an application procedure. It must satisfy the statutory requirements, including a clear statement of the relief sought, the facts and the grounds.

In practice, an application is usually prepared by a lawyer and filed with the competent court, after which the matter is dealt with in chambers or at a hearing.

“The lawyer filed an application with the court on behalf of the client to modify the contact arrangements with the children.”
