Joinder
Joinder is the voluntary accession of a third party to pending civil proceedings in order to protect its interests.
Intervention is a procedural mechanism under which a third party joins ongoing civil proceedings before the court. This may occur either on the side of the claimant or on the side of the defendant, provided the third party has a direct and sufficient interest in the outcome of the case.
Intervention enables third parties to protect their rights without instituting separate proceedings. In this way, it enhances the efficiency of the administration of justice and reduces the risk of conflicting judgments.
In practice, intervention is commonly sought in disputes involving multiple parties, such as contractual or liability cases, with the court determining whether the application should be granted.
“The injured third party requested joinder in the proceedings between the insurer and the liable party in order to secure its compensation.”
