Wat is misbruik van omstandigheden

What is abuse of circumstances?

Abuse of circumstances consists in exploiting another person’s vulnerable position in order to bring about a detrimental juridical act. This may result in the avoidance of the agreement.

Abuse of circumstances is a legal doctrine in Dutch civil law whereby one party exploits the special circumstances in which the other party finds itself, such as dependency, mental or physical vulnerability or financial distress. Pursuant to Article 3:44 of the Dutch Civil Code, the juristic act is then voidable.

The concept is significant because it protects vulnerable parties against undue influence and inequitable contracts. It provides a corrective mechanism where a party’s intention has not been formed in the ordinary manner.

In practice, abuse of circumstances is frequently invoked in respect of agreements concluded under pressure arising from debts, illness or emotional dependency, for example in family matters or consumer disputes.

“The court annulled the loan agreement on the grounds of abuse of circumstances, as the lender had taken advantage of the customer's acute financial distress.”
