Weigerambtenaar
refusing civil servant
A weigerambtenaar is a civil registrar who refuses to solemnize marriages between persons of the same sex on grounds of conscientious objection.
A weigerambtenaar is a municipal officer responsible for solemnizing marriages who, on the basis of personal, often religious convictions, refuses to solemnize marriages between persons of the same sex. The term emerged following the introduction of same-sex marriage in the Netherlands in 2001 and reflects the tension between freedom of religion and the principle of equality.
Municipalities are required to ensure that a sufficient number of officers willing to solemnize such marriages are available, so as to prevent discrimination. Officers who refuse may remain in post, provided the municipality makes alternative arrangements and the refusal does not result in delay or unequal treatment of couples.
In practice, the matter gives rise to debate concerning the rights of LGBTI persons and the position of officers with conscientious objections, with legislation imposing requirements on the organization of the civil registry.
“The municipality ensured that the civil registrar who objected to performing same-sex marriages was not assigned to officiate at the wedding of the lesbian couple.”
