WOR

Works Councils Act

The WOR is the Works Councils Act, which regulates the establishment, composition and powers of works councils in Dutch undertakings.

The Works Councils Act (WOR) is a Dutch statute governing employee participation within undertakings. The Act requires employers with fifty or more employees to establish a works council and prescribes the rights and obligations of that council.

The WOR is relevant in that it affords employees a voice in decisions affecting their work and working conditions, such as reorganisations, mergers and alterations to terms and conditions of employment. This promotes a balanced relationship between employer and employees.

In practice, the WOR ensures that the works council possesses advisory and consent rights, thereby contributing to improved decision-making and helping to prevent the adoption of unilateral measures.

“The employer was required to submit the proposed decision to reduce the workforce to the works council for approval pursuant to the Works Councils Act.”
