Property damage

Property damage is the material damage inflicted on a thing or property, such as the damaging or destruction of goods.

Property damage refers to the diminution in value or the repair costs of a physical object resulting from a tort or breach of contract. This category of loss is distinct from personal injury, which encompasses bodily harm or non-pecuniary consequences.

In Dutch liability law, property damage is significant because the injured party is entitled to compensation for the loss actually sustained, typically measured by reference to repair costs or diminution in value. Insurers and courts routinely apply this concept when evaluating claims.

In practice, property damage frequently arises in traffic accidents, cases of arson or contractual disputes involving goods.

“The insurer compensated the property damage to the damaged vehicle after the accident.”
