Maternity leave
Pregnancy leave is the paid leave that a female employee takes around the time of childbirth pursuant to the Work and Care Act.
Pregnancy leave consists of a period of pregnancy leave prior to the expected due date and maternity leave thereafter. The total duration is sixteen weeks and is intended to protect the health of the mother and child and to enable the employee to recover.
The employer continues to pay the salary and may recover the amount from the UWV. The employee must apply for the leave in good time and submit a statement from the midwife or gynaecologist.
In practice, disputes frequently arise regarding the precise commencement date, continued payment of wages in the event of illness during the leave, or protection against dismissal.
“The employee has requested her maternity leave from the employer and it commences six weeks prior to the expected due date.”
