To institute proceedings

The commencement of judicial proceedings by bringing a case before the competent court.

Commencing proceedings is the formal process by which an action is initiated before the court. This is generally effected by serving a writ of summons or filing a petition with the court.

By doing so, the matter becomes officially pending before the court, which thereby acquires jurisdiction, and the applicable procedural time limits begin to run. In the absence of such commencement, no judgment on the merits may be rendered.

In practice, it is essential to observe the correct procedure and all requisite formalities in order to ensure the admissibility of the claim.
