Works Permit

An installation permit is an official authorization to carry out specific works activities in the physical living environment, such as the laying of hard surfaces, pipelines or alterations to the terrain.

In Dutch environmental law, the works permit is a permit granted for operations falling within the activity of “laying out”. This permit governs, inter alia, the installation of hard surfacing, alterations to ground levels and the placement of certain installations.

The works permit ensures that such operations comply with the applicable zoning plan, environmental standards and other applicable rules. In the absence of this permit, projects may be unlawful and may give rise to enforcement action or orders for cessation.

In practice, the works permit is commonly applied for at municipal level in respect of infrastructural or public works, with the applicant required to demonstrate that the activity will have no adverse effects on the surrounding area.

“The contractor has applied for a works permit to construct the new cycle paths in the park.”
